What is the EB-5 program?

The EB-5 program is a highly beneficial option for you and your family to get green cards and eventually become US citizens by investing in the United States. For many without family or an offer of employment in the US, the EB-5 program can be the only way to get permanent resident status. It requires an investment of $1 million (or $500,000 in a high unemployment or rural area) in a commercial enterprise that will employ 10 full-time US workers.

 


What type of investment can I make?

There is no limit to the type of investment you can make, so long as it meets the minimum dollar amount and creates at least 10 jobs. While foreign investors are free to directly invest in the US, many chose to invest though an EB-5 Regional Center. A Regional Center is an entity that is authorized by the US Citizenship and Immigration Services (“USCIS”) to administer EB-5 investment projects. They will manage the investment and ensure that the EB-5 requirements are satisfied, allowing the investor to take a more hands-off approach. In exchange, Regional Centers charge an administrative fee for their service.

 


What is the EB-5 process?

There are three general steps to obtain permanent residency.

 

  1. Select an investment that is likely to create at least 10 jobs and makes a commitment to invest either $500,000 or $1 million, depending on where the investment is made.

  2. Our firm submits the necessary immigration forms along with supporting documentation describing the investment in detail. The application must convince USCIS that the investment will create at least 10 jobs. Upon approval of the application, you and your family are eligible for two-year green cards, allowing you to immigrate to the US.

  3. Before the expiration of the two-year green card, our firm submits additional documentation to show that the investment has in fact created 10 jobs. Upon approval, you and your family are given permanent-resident status.

 


How long does it take to get permanent resident status?

The entire process from finding an appropriate investment to becoming a permanent resident involves several steps and takes a few years. Generally, it will take about two years to get temporary green cards, which will allow you to immigrate to the US. After receiving temporary green cards, it can take an additional 3 to 4 years to get permanent green cards.
